⚠️ Important Notice About Digital Products

For digital content that is delivered immediately upon purchase, you waive your right of withdrawal by completing the purchase and confirming immediate access.

This is in accordance with § 356 para. 5 BGB (German Civil Code) and Art. 16(m) of the EU Consumer Rights Directive 2011/83/EU.

1. Right of Withdrawal for Consumers

1.1 Who Has the Right of Withdrawal?

If you are a consumer (a natural person acting for purposes that are predominantly neither commercial nor self-employed), you generally have the right to withdraw from your purchase within 14 days without giving any reason.

Definition of Consumer: According to § 13 BGB, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Note: This right does NOT apply to businesses, companies, or entrepreneurs purchasing for commercial purposes.

1.2 Withdrawal Period

The withdrawal period is 14 days from the day of contract conclusion (for digital products, this is the date of purchase).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

2. Exception: Digital Content with Immediate Access

2.1 Loss of Withdrawal Right

According to § 356 para. 5 BGB, the right of withdrawal expires for contracts for the delivery of digital content not on a physical medium if:

  1. You have given your express consent to us beginning the performance of the contract before the end of the withdrawal period
  2. You have acknowledged that you lose your right of withdrawal by giving such consent
  3. We have provided confirmation of the contract and this information on a durable medium (email)

2.2 How This Applies to Our Products

All our digital products (research reports, subscriptions, dashboard access) are delivered digitally and made immediately accessible upon purchase. Therefore:

  • Check a box explicitly consenting to immediate access to the digital content
  • Acknowledge that by giving this consent, you lose your right of withdrawal
  • Confirm that you understand the content is available immediately after purchase

3. How to Exercise Your Right of Withdrawal (If Applicable)

3.1 Notification of Withdrawal

If you wish to withdraw from your contract (in cases where the right has not been waived), you must inform us of your decision by means of a clear statement.

3.2 Ways to Communicate Withdrawal

You may use any of the following methods:

  • Send an email clearly stating your intention to withdraw
  • Send a letter by post to our address above
  • Use our contact form (if you clearly state your withdrawal)
  • Use the model withdrawal form provided below (optional)

3.3 Confirmation

We will send you an acknowledgment of receipt of your withdrawal without undue delay (via email).

5. Effects of Withdrawal (If Applicable)

5.1 Refund Obligations

If you validly withdraw from your contract (i.e., before you consented to immediate access), we will refund all payments received from you, including delivery costs (except for additional costs resulting from choosing a type of delivery other than the least expensive type of standard delivery offered by us).

5.2 Refund Timeline

We will make the refund without undue delay, and not later than:

  • 14 days after the day on which we receive notice of your withdrawal

5.3 Refund Method

We will use the same payment method you used for the original transaction, unless you expressly agree otherwise. In any case, you will not incur any fees as a result of the refund.

6. Special Cases and Exceptions

6.1 Subscription Services

For subscription services (e.g., monthly or yearly dashboard access):

  • The right of withdrawal applies to the initial subscription purchase if you have NOT yet accessed the service
  • Once you access the subscription content, the right of withdrawal is waived (with your prior consent)
  • You can cancel ongoing subscriptions at any time for future billing periods (this is not a withdrawal, but a cancellation)

6.2 Business Customers

If you are purchasing as a business, company, or entrepreneur (not a consumer as defined in § 13 BGB), the right of withdrawal does NOT apply to you. Business transactions are governed by the general terms in our Terms of Service.

6.3 Gift Codes

For gift codes that have not been redeemed:

  • The purchaser has a 14-day right of withdrawal if the gift code has not been sent or used
  • Once a gift code is sent to the recipient or used, the right of withdrawal is lost

7. Summary of Your Consumer Rights

  • If you are a consumer (not a business)
  • Within 14 days of purchase
  • BEFORE you access the digital content

✗ You LOSE the right of withdrawal:

  • When you consent to immediate access at checkout
  • When you acknowledge losing your withdrawal right
  • After you access/download the digital content

8. Legal Framework

This Right of Withdrawal policy is based on the following legal provisions:

  • §§ 312g, 355-356 BGB (German Civil Code) - Right of withdrawal for distance contracts
  • EU Directive 2011/83/EU (Consumer Rights Directive) - Consumer protection for distance and off-premises contracts
  • Article 16(m) - Exception for digital content with immediate delivery
